General Counsel
To avoid misunderstandings and problems, everyone needs an attorney for general legal advice, guidance and referrals for attorneys who specialize in a given area of the law. Locating the right attorney for you is paramount. Schedule consultations with several local attorneys and look for that perfect fit. You will know the right attorney for you when you feel completely at ease discussing your needs.
To do their job effectively, attorneys require the truth from their clients, so it is important that you feel close enough to your attorney to be honest from the start.

Uncontested Divorce
An uncontested divorce is possible when both parties agree in advance to every detail of a divorce, including, but not limited to: the division of marital assets, alimony, as well as child custody and support payments if applicable. Once the terms for divorce are on paper the parties will each sign and an attorney will file the paperwork with the court.
The Cost of Uncontested Divorce
As it is limited to the attorney’s fee plus the filing fees of court, an uncontested divorce is the least expensive type of divorce.
Benefits of Uncontested Divorce
Worthwhile reasons to consider an uncontested divorce include cost, privacy and time. Uncontested, or amicable divorces are the least expensive way to end a marriage. As only the terms of divorce become public record, no details everyone would prefer to remain private are captured and recorded as a public record. Another benefit of uncontested divorce is the speed at which a divorce decree can be attained; usually as little as forty-five days.
Contested Divorce
Going through a contested divorce is an arduous and exhausting process for everyone involved, especially children.
Under the incredibly heated and intense emotional stress of the divorce process, it is common to make mistakes which have lasting and devastating consequences on you and your family.
When divorce is the only possibility for happiness, the best results are produced with critical and analytical divorce planning.
Divorce Planning
The best divorce planning is accomplished in a confidential setting with a seasoned attorney who specializes in divorce. It is also crucial that the attorney you choose has experience winning divorce cases with circumstances similar to your own in the county in which your divorce will be filed and heard.
Strategic divorce planning begins with preparing finances. Appropriate funds should be set aside in advance for living arrangements and expenses throughout the divorce process.
Create a complete and up to date file on all assets. Gather and copy financial documents including bank and brokerage statements as well as real estate holdings.
What is Mediation
Mediation is an alternative to court in which the parties in dispute retain the power of decision making, negotiate and mutually agree on a resolution in a private setting. Because mediation can be less expensive and takes less time than traditional court proceedings, it has become popular for family law cases, civil and business disputes.
What Happens in Mediation
What happens in mediation, stays in mediation! Privacy may be the single most attractive aspect when comparing mediation to court. Because mediation is held in a private setting and does not produce public records as do traditional court proceedings, people and companies alike are delighted to keep their dirty laundry in the closet.
How the Process of Mediation Works
A mediator is mutually selected and approved by the attorneys of both sides in advance. Each party arrives at mediation with his attorney and is ushered into a private room. The two parties in dispute will not be in the same room at the same time. The mediator will spend time with each party independently and go back and forth negotiating and calibrating the terms of a resolution in which both parties ultimately agree.
The Start of Mediation
The mediator will enter the room assigned to you and your attorney to explain how the process works and establish the rules of this mediation. Next, the mediator will hear your opening statement which will include your grievances as well as the goals you would like to achieve in order to reach a resolution. After your opening statement the mediator will go to the room where the other side is waiting to give their opening statement and begin the negotiations.
Mediation Negotiations
The mediator will go back and forth between the parties negotiating each of the terms needed to arrive at a mutually equitable resolution. Depending upon the circumstances and the willingness of the parties to give and take, this process will may take minutes, hours or even days.
The Conclusion of Mediation
The conclusion of mediation occurs when both parties sign the resolution with the negotiated terms. The resolution is filed and becomes permanent and binding.
If Mediation Fails
Mediation is voluntary; therefore the parties may refuse all or part of the terms being negotiated by the mediator, making a failed mediation possible. When mediation fails the parties in dispute may attempt mediation again or take they may their chances in court and a judge will render verdict.
